Using these consistency conditions, we determine the ordering, payment, delivery and product complaints which are offered on this site. Our web page can be used for your private purposes free of charge for the use, according to the following terms and conditions.
Photo policy
Photography for personal enjoyment is encouraged on all our tours. We know you’ll have a pleasant experience you want to capture. We do have a few guidelines we ask all our visitors to follow for the enjoyment of everyone on our tours.
By entering Blue Cave Express you consent to interviews, photography, video and audio recordings to be used for webcasts, promotional purposes, advertising or any other purposes
By entering Blue Cave Express, you renounce all rights you may have to any claims for payment in connection with any exhibition, streaming and webcasting. You also give up any right to inspect or approve any photograph, video or audio recording taken by Blue Cave Express
Images are strictly prohibited from being reproduced, copied, or altered in any way other than by Blue Cave Express and its official representatives
Blue Cave Express are not obligated to remove your voice or likeness from any interview, photography, audio and video recording, to be used for news, webcasts, promotional purposes, advertising, inclusion on web sites, or any other purpose, but will consider removing any photographs or recordings at the written request of the individual

Ordering
The client may make a reservation for any service offered on the web page www.bluecaveexpress.com by our online booking system or by e mail for sea and land transfer, telephone, fax or other means of remote communication, or with other authorised agents.
Payment
All payments will be effected in Croatian currency (Kuna). The charged amount on your credit card account is converted into your local currency according to the exchange rate of credit card associations.
Blue Cave Express uses WSPay for online payments.
WSPay is a secure system for online payments, real time credit and debit card payments, and other payment methods. WSPay ensures the buyer and the merchant with the secure card data entry and transfer, which is also confirmed by PCI DSS certificate. WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.
Blue Cave Express takes data protection and privacy very seriously.
We collect only relevant and necessary data to accomplish the specified purpose and to meet our obligations. Our buyers are informed about the way the collected data is used, moreover, they can control and determine how their personal data is used. Buyers can also decide whether they want their name removed from the list used for marketing campaigns. All user personal data is kept strictly confidential. It is available only to employees who require such data to perform their work tasks. All employees of Blue Cave Express and business partners are obliged to demonstrate that their activities are compliant with the Data Protection Principles.

WSPay, being the processor of authorization and payment made by credit cards, uses personal data as the processor pursuant to the General Data Protection Regulation of the European Parliament and the Council no. 2016/679, and compliant with PCI DSS Level 1 Regulations for data transfers.
WSPay uses 256-bit SSL encryption and TLS 1.2 cryptographic protocol as the highest protection standards for data entry and transfer.
Personal data used for the purposes of authorization and payment are deemed to be confidential data.

WSPay does not process or use these personal data except for the purpose of fulfilling the Agreement, the authorization and the payment.
WSPay ensures to meet the requirements determined by applicable personal data protection regulations, for the processors of personal data, especially taking all necessary technical, organizational or security measures confirmed by PCI DSS Level 1 certificate.
We offer various payment methods
-by wire transfer and major credit and debit cards, through our web site booking system, or on selling points
-by cash on our selling points.
Cancellation
All cancellation fees held by Blue Cave Express are only intended to cover our direct cost of amending and/or cancelling your reservation.
For all bookings of day tours operated by Blue Cave Express, a minimum of 24 hours’ notice of cancellation or amendment prior to your scheduled tour departure is required for a full refund.
If a cancellation is made with less than 24 hours’ notice prior to departure no refund is given.
Cancellation fee penalty
If a cancellation is made with less than 24 hours’ notice prior to your schedulded tour departure Blue Cave Express retains 100% of the paid amount
Refunds, terms of return and complaint
If the trip is not feasible on the day that your reservation is valid due to factors such as unfavourable weather conditions, engine breakdowns, etc. we do a complete refund. The evaluation of the feasibility of the trip and the final decision is done by the captain.
In case of complete failure to provide the service, for any reason whatsoever, the customer shall be reimbursed for the full amount which has been paid in advance for the service in question.
Insurance
For the entire duration of the trip, insurance is valid for the consequences of accidents and injuries, excluding any harm or damage caused by the consummation of food and beverages that are not included in the price of the trip.
Exclusions
A guest is familiar with everything that the itinerary and the price include and exclude which is noticeable on our web page www.bluecaveexpress.com
Conditions of delivery
We deliver the service which is agreed upon in advance, on the day for which the reservation is valid, for which the payment has been received in advance.
Travel documents
Blue Cave Express send an invoice to the client by e-mail upon receipt of booking or after purchasing services online. The client is required to show the documents of the person under which name the reservation was made.
While buying on the points of sale, the client is obligated to take a bill that serves as a credible document for the tour.
Customer Complaint Notice
Based on Art. 10, Consumer Protection Law (No. 41/14, 110/15) and Art. 6. The Law on Provision of Tourism Services (Art.No. 130/17) we inform the consumers that the quality complaint about each service performed can be made directly on the premises of the company Blue Cave Express / Best Prefer d.o.o. or delivered in writing to the following address: Tijardovićeva 4, Split or to an email address: info@bluecaveexpress.com
Blue Cave Express / Best Prefer d.o.o. undertakes to acknowledge receipt of the objection in writing in the same way as it has received the objection in question without delay. The answer to your complaint will be delivered in writing no later than 15 days after the receipt of the complaint. Please provide your name and last name and address so that we can provide you with a written response to your complaint within the deadline and thus improve the quality and your satisfaction, on our Blue Cave Express e-mail: info@bluecaveexpress.com
